Terms of Service

These terms are the agreement between you and Oarly (“we”), the operator of oarly.app, covering the Oarly app and this website. By creating an account or using the app you accept them. Please read section 2 in particular, because it describes something Oarly deliberately does not promise.
1. What Oarly does
Oarly rings your phone at a time you choose and plays a spoken reminder. Reminders can be created in the app or by adding your Oarly email alias to a calendar invitation. On a plan that covers other people (Together or Family) you can set up a profile for someone else and receive their check-ins. Calls are made over the internet to the Oarly app. Oarly does not use the telephone network, does not have or dial phone numbers, and cannot reach you if the app is not installed and running.
2. Oarly is not an emergency, medical or safety service
This is the most important thing on this page.
- Oarly is a convenience reminder tool. It is not a medical device, a care service, a monitoring service, or a personal emergency response system, and it must not be used as one.
- We do not guarantee that any call will be delivered, on time or at all. Delivery depends on your phone having power, having a working internet connection, and on its operating system choosing to let our notification through. Some Android manufacturers aggressively suspend background apps, and when that happens a call cannot reach you and we may have no way of knowing. The app will help you configure your phone to reduce this, and it cannot eliminate it.
- A call can also arrive late. Even on a phone that is set up correctly and working normally, a reminder usually rings within a few seconds of the time you chose, and occasionally minutes after it. That delay comes from how phones receive notifications, so no setting on your phone and no step in our setup guide removes it. Treat the time you choose as the earliest a call will arrive.
- A missed check-in does not mean something is wrong, and an alert arriving does not mean anyone has been reached. A silent phone means we have no information, nothing more. Never treat a check-in, or its absence, as confirmation of anybody’s wellbeing.
- Do not rely on Oarly for medication, medical appointments, legal or financial deadlines, or any situation where a missed reminder could cause harm or loss, unless you have another independent reminder in place.
- In an emergency, call your local emergency number. Oarly cannot contact emergency services and will never do so on your behalf.
3. Who may use Oarly
You must be at least 13 years old to create your own Oarly account, and old enough to enter a contract where you live. A parent or guardian may set up a managed profile for a younger child and is responsible for it.
4. Setting up Oarly for another person
A plan that covers other people (Together or Family) lets you create a profile for someone else and, if they agree, receive their check-in replies and location. By doing so you confirm that:
- you have that person’s permission, or parental responsibility for them;
- you have told them Oarly is set up on their phone and what it will do, and you will not conceal it from them;
- you accept that they control their own recording and location switches and can turn them off or delete their profile at any time, without needing your approval.
Using Oarly to monitor an adult without their knowledge is a serious misuse of it and grounds for us closing your account.
5. Your account
Keep your password to yourself. You are responsible for what happens under your account. Tell us at hello@oarly.app if you think someone else has access.
Your email alias is yours while your account exists. If your account is deleted the alias is released and may later be taken by someone else. Aliases are allocated as they are claimed, and we may reclaim one that is being used to impersonate somebody or to abuse the service.
6. Acceptable use
Do not use Oarly to:
- harass, stalk, threaten or covertly monitor anyone;
- send content that is unlawful, or that you have no right to send;
- place calls to people who have not agreed to receive them, or set up profiles for people who have not agreed;
- attack, overload, reverse engineer or work around the limits of the service, or use it to send automated bulk messages.
We may suspend or close an account that does any of this. Where it is reasonable to do so, we will tell you why first.
7. Plans, trials and payment
- Oarly is free to download and includes a 14 day trial of all features. No card is needed to start it.
- After that, Oarly is a paid subscription. Current prices are shown in the app and on the store page before you buy.
- Subscriptions are sold by Google Play or the App Store, not by us. They take the payment, they renew it, and they handle refunds under their own policies. We only learn from them whether your subscription is active.
- Subscriptions renew automatically until you cancel. Cancel through the store, not through us: we have no ability to cancel or refund a store subscription on your behalf.
- We never see your card details and we do not process refunds, so we can neither grant nor refuse one. Using your legal right to withdraw is always fine. Repeatedly subscribing and then refunding in order to keep using Oarly without paying for it is not, and we may close an account that does it.
- If your subscription lapses, your account and data remain, and calls stop going out until it is renewed.
If you are a consumer in the EU you have a legal right to withdraw from a distance contract within 14 days. Because the store is the seller, exercise it through the store’s refund process, which is the faster route in any case.
8. Support
Support is by email at hello@oarly.app. We answer as quickly as we can, and we do not promise a response time.
- If Oarly is not ringing, start at oarly.app/support/not-ringing. Almost every phone that stops ringing has a battery or notification setting switched off, and that page walks through them by make of phone.
- Anything to do with paying, cancelling or a refund goes to Google Play or the App Store, not to us. See section 7.
- There is no telephone support. Oarly has no phone numbers anywhere in it, ours included.
None of this reduces your statutory rights as a consumer, or our obligation to provide the service you have paid for.
9. Changing and ending the service
We will improve, change and occasionally remove features. If we make a change that materially reduces what you are paying for, we will tell you in advance and you may cancel. You can stop using Oarly and delete your account whenever you like, in the app or at oarly.app/delete-account. We may close an account that breaks these terms, or the whole service on reasonable notice.
10. Your content
Your reminders and recordings are yours. You give us only the permission we need to run the service for you: to store them, convert them to speech, transcribe a check-in reply, and show it to the person you agreed could see it. We do not use your content to train models and we do not use it to advertise to you.
11. What we are responsible for
Oarly is provided as it is. We do not promise it will be uninterrupted, error free, or that a call will always arrive, and section 2 explains why that is a real limitation rather than boilerplate.
To the fullest extent the law allows, we are not liable for anything you missed, lost or failed to do because a Oarly call did not arrive or arrived late, nor for indirect or consequential loss. Where we are liable, our total liability is limited to what you paid us in the 12 months before the claim.
Nothing here limits liability that cannot be limited by law: death or personal injury caused by our negligence, fraud, or your rights as a consumer under the law of the country you live in, which these terms do not take away.
12. Law and disputes
These terms are governed by the law of the country in which Oarly is established. If you are a consumer, none of that takes anything away from you: you keep the full protection of the mandatory consumer law of the country where you live, and you may bring proceedings there, in your own courts.
Talk to us first at hello@oarly.app. Most things are quicker to fix than to argue about.
13. Changes to these terms
We will post any new version here and change the date at the top. If a change is significant we will tell you in the app before it takes effect. Continuing to use Oarly after that means you accept it.
